SCOPE

ORDER AND CONCLUSION OF CONTRACT

You place an order in our online shop. As soon as you have accepted the Terms and Conditions and clicked the BUY button, the order is binding. A legally valid purchase contract is concluded. As soon as we receive your order, we will send you an order confirmation by e-mail.

OUR DELIVERY AND SALES CONDITIONS

After the order confirmation, we will send the ordered items to the delivery address you provided. The usual delivery time is 2 – 5 working days.
If delivery of the goods fails despite several delivery attempts, we may withdraw from the contract.

OFFER

Our online offer is subject to change and non-binding. As a rule, the items offered in the online shop are available. Should it not be possible to deliver one or more items due to a stock discrepancy, we will inform you of this as quickly as possible. Amounts paid will be refunded as quickly as possible. Order quantities must correspond to normal household quantities.

Prices

Our stated prices are gross prices ex warehouse and include statutory VAT.
Prices are stated in the currency of the respective country of delivery (Switzerland and Liechtenstein in CHF, EU countries in EUR). Shipping costs, if any, are shown separately during the ordering process. 

DELIVERY AND SHIPPING

Shipping (B-Post) is free of charge for deliveries within Switzerland and the Principality of Liechtenstein. For A-Post, we charge CHF 7.00.

PAYMENT OPTIONS

For orders within Switzerland and the Principality of Liechtenstein, the payment methods prepayment, invoice, credit card and PayPal are available to you. Orders from abroad can only be paid via prepayment, credit card or PayPal.

INVOICE

If you order on invoice, the invoice will be sent to you by e-mail. The invoice is due within 30 days of dispatch of the goods. You can conveniently pay the invoice cashless by postal or bank transfer within this period.

Purchase on invoice is processed by our external payment partner MF Group / POWERPAY.

CREDIT CARD & ONLINE PAYMENT

You can conveniently pay for your order by credit card (AMEX, VISA, Mastercard) or PayPal via Shopify's secure payment system.

Alternatively, TWINT and PostFinance (PostFinance Card and PostFinance E-Finance) are also available to you as payment options.

LATE PAYMENT

In the event of late payment, we are entitled to charge you a fee of CHF 9.00 from the 2nd reminder onwards. Reminders and invoices are sent by e-mail. In the event of late payment, we are also entitled to assign the claim and the resulting costs for the debtor to third parties. We reserve the right to assert further claims for damages.

VOUCHER

Gift vouchers are vouchers that you can purchase. You can pay for your order with a Noser Fashion voucher. To do so, enter the code on the voucher in the corresponding field of the order. A gift voucher can only be redeemed before the ordering process is completed and for the full amount.

The voucher amounts are predefined. Vouchers are issued exclusively in CHF and are freely transferable.

Cash payment is excluded.

PROMOTIONAL VOUCHERS

Promotional vouchers (vouchers that you cannot purchase, but which we issue as part of advertising campaigns with a specific period of validity) are valid only for our shop, only during the stated period, and can only be redeemed once per ordering process.

Promotional vouchers can be redeemed from a minimum order value of CHF 50.00; the value of the goods must in any case be at least equal to the amount of the promotional voucher. Any difference to a higher value of goods must be settled using the payment options offered. Promotional vouchers are neither paid out in cash nor do they bear interest.

A refund of promotional vouchers is excluded in the event of partial or complete return of the ordered products. Promotional vouchers can only be redeemed before the ordering process is completed. Subsequent crediting is not possible. The promotional voucher is not transferable and may not be combined with other promotional vouchers. If you used a promotional voucher for your purchase, we reserve the right to charge you the original price of the goods you keep if – due to your withdrawal – the total value of the order falls below the value of the promotional voucher.

RETENTION OF TITLE

The goods remain the property of Noser Fashion until the purchase price has been paid in full.

RIGHT OF WITHDRAWAL/RIGHT OF RETURN

You can withdraw from the contract within 14 days of receipt of the goods by returning the goods with a description of the reason for the return. The goods are returned at your own responsibility and expense.

Only items that are completely undamaged and in perfect, unworn condition will be accepted for return. In particular, worn, soiled, damaged or bad-smelling products cannot be taken back. Should this not be the case, we reserve the right to assert claims for compensation.

You will receive the return address after successfully registering in the returns portal.

Return address by country of origin
Returns from the EU are sent to an address in Germany.
Returns from Switzerland are sent to a Swiss return address.
The respective address is shown in the returns portal.

Refund
If you pay by invoice, you can deduct the amount of a returned item from the total amount. If the total amount has already been transferred to us, you can choose between a voucher or a refund. Shipping costs are not refunded.

Orders that have already been paid will be credited promptly after receipt and inspection of the return.

Exchange
If you would like to exchange an item (e.g. a different size or color), please place a new regular order. Unfortunately, a direct exchange within an existing order is not possible.

DELIVERY DEFECTS

Please check the delivered items immediately for correctness, completeness and integrity. Complaints regarding the scope of delivery, material defects, incorrect deliveries and quantity discrepancies must be notified to us in writing within 5 working days of receipt of the goods. We will examine defects without delay. If the defects are accepted, you will receive an identical replacement item, if in stock, and the shipping costs will be refunded. Otherwise, the full amount will be refunded to you.

WARRANTIES
The statutory provisions apply to warranty claims for defects.

DATA PROTECTION

The protection of your personal data is very important to us. We comply with the applicable data protection regulations and protect your data against unauthorized access by third parties (data security measures).

Our online shop is encrypted using SSL (Secure Socket Layer), which means that all data of the offer as well as your payment and customer data are transmitted to us securely.

We are entitled to use your personal data to send you special offers or information about new collections. You can revoke your consent to the use of your personal data for advertising purposes at any time by e-mail to info@noser-fashion.com.

We protect our website and other systems by technical and organizational measures against loss, destruction, access, modification or dissemination of your data by unauthorized persons. Access to your customer account is only possible after entering your personal password.

This website contains social media buttons. By activating the buttons, you come into direct contact with the respective social network. These networks may use their users' personal data in a manner that does not comply with data protection law, as insufficient information is provided about the use of the data. Noser Fashion is not liable for damages incurred by you as a result of the misuse of your personal data by social networks.

APPLICABLE LAW AND PLACE OF JURISDICTION

The place of performance for the seller's delivery is the respective place of dispatch. The place of performance for all other obligations is Vaduz/FL. The place of jurisdiction for all legal disputes arising from the business relationship is Vaduz/FL.
The contract concluded between the contracting parties remains binding even if individual provisions or individual clauses of these terms and conditions are legally invalid. An invalid provision and an invalid term shall be replaced in good faith by a provision that comes closest to the purpose of the invalid provision or term and ensures that the economic purpose of the contract is achieved.
We accept no liability for possible typing and printing errors.
