SCOPE

ORDER AND CONTRACT CONCLUSION

You place an order in our online shop. As soon as you have agreed to the GTC and pressed the BUY button, the order is binding. A legally valid purchase contract is created. As soon as we receive your order, we will send you an order confirmation by e-mail.

OUR DELIVERY AND SALES CONDITIONS

After order confirmation, we will send you the ordered items to the delivery address you provided. The usual delivery time is 2 – 5 working days.
For orders from abroad, the delivery time may be extended by up to 10 working days.
If delivery of the goods fails despite multiple delivery attempts, we may withdraw from the contract.

OFFER

Our online offer is non-binding and without obligation. Usually, the items offered in the online shop are available. If it is not possible to deliver one or more items due to a stock discrepancy, we will inform you as soon as possible about this circumstance. Paid amounts will be refunded as quickly as possible. Order quantities must correspond to household quantities.

Prices

Our stated prices are gross ex warehouse and are quoted in Swiss francs including statutory VAT and shipping costs. 

DELIVERY AND SHIPPING

For deliveries within Switzerland and the Principality of Liechtenstein, shipping (B-Post) is free of charge. For A-Post, we charge CHF 7.00.

PAYMENT OPTIONS

For orders within Switzerland and the Principality of Liechtenstein, the payment methods prepayment, invoice, credit card, and PayPal are available. Orders from abroad can only be paid via prepayment, credit card, or PayPal.

Purchase on account with installment option (POWERPAY)

MF Group / POWERPAY offers the payment method "purchase on account" as an external payment service provider. With the individual invoice, you can easily pay for your online purchase by invoice. If you do not make a payment within the specified time frame, you will receive a monthly invoice with an order overview retroactively in the following month.

When concluding the purchase contract, POWERPAY takes over the resulting invoice claim and handles the corresponding payment modalities. When purchasing on account, you accept the POWERPAY terms and conditions in addition to our GTC. (powerpay.ch/de/agb).

PREPAYMENT

For an order with prepayment, the invoice will be sent to you by e-mail. The invoice is due within 30 days. You can conveniently pay the invoice cashlessly by postal or bank transfer within this period. After receipt of payment, we will immediately send you your order.

INVOICE

For an order on account, the invoice will be sent to you by e-mail. The invoice is due within 30 days after shipment of the goods. You can conveniently pay the invoice cashlessly by postal or bank transfer within this period.

CREDIT CARD

You can also pay for your order by credit card (VISA, Mastercard) or PayPal via the secure payment system Wallee.

PAYMENT DEFAULT

In case of payment default, we are entitled to charge you a fee of CHF 9.00 from the 2nd reminder onwards. Reminders and invoices are sent by e-mail. In case of payment default, we are also entitled to assign the claim and cost consequences for the debtor to third parties. The assertion of further damages remains reserved.

VOUCHER

Gift vouchers are vouchers that you can purchase. You can pay for your order with a voucher from Noser Fashion. To do so, enter the code on the voucher in the corresponding field of the order. A gift voucher can only be redeemed before completing the order process and for the full amount.

The amount of the voucher values is predetermined. The vouchers are issued exclusively in CHF and are freely transferable.

Cash payment is excluded.

PROMOTIONAL VOUCHERS

Promotional vouchers (vouchers that you cannot purchase but that we issue as part of advertising campaigns with a specific validity period) are only valid for our shop, only during the specified period, and can only be redeemed once per order process.

Promotional vouchers can be redeemed from a minimum order value of CHF 50.00; the merchandise value must in any case be at least the amount of the promotional voucher. Any difference to a higher merchandise value must be compensated with the offered payment options. Promotional vouchers are neither paid out in cash nor do they bear interest.

A refund of promotional vouchers is excluded in case of partial or complete return of the ordered products. Promotional vouchers can only be redeemed before completing the order process. Subsequent crediting is not possible. The promotional voucher is non-transferable and may not be combined with other promotional vouchers. If you have used a promotional voucher for your purchase, we reserve the right to charge you the original price of the goods you keep if – due to your withdrawal – the total value of the order falls below the value of the promotional voucher.

RETENTION OF TITLE

The goods remain the property of Noser Fashion until full payment of the purchase price.

RIGHT OF WITHDRAWAL/RETURN POLICY

You can revoke the contract within 10 days after receipt of the goods by returning the goods with a description of the reason for return. The return of the goods is at your responsibility and expense.

Only items that are absolutely intact and in flawless, unworn condition will be accepted for return. In particular, worn, soiled, damaged, or badly smelling products cannot be returned. If this is not the case, we reserve the right to assert claims for compensation.

The return address will be provided to you after successful registration in the returns portal.


You can deduct the amount of a returned item from the total amount. If the total amount has already been transferred to us, you can choose between a voucher or a refund. Shipping costs are not covered.

DELIVERY DEFECTS

We ask you to check the delivered items immediately for correctness, completeness, and intactness. Complaints regarding delivery scope, material defects, wrong deliveries, and quantity deviations must be reported to us in writing within 5 working days after receipt of the goods. Defects will be examined by us immediately. If the defects are accepted, you will receive, if available, a replacement item as well as a refund of the shipping costs. Otherwise, the entire amount will be refunded to you.WARRANTIES
The statutory provisions apply for warranty in case of defects.

DATA PROTECTION

The protection of your personal data is very important to us. We comply with applicable data protection regulations and secure your data against unauthorized access by third parties (data security measures).

Our online shop is encrypted using SSL (Secure Socket Layer), ensuring that all data of the offer as well as your payment and customer data are securely transmitted to us.

We are entitled to use your personal data to send you special offers or information about new collections. You can revoke your consent to the use of your personal data for advertising purposes at any time by email to info@noser-fashion.com.

We secure our website and other systems through technical and organizational measures against loss, destruction, access, alteration, or dissemination of your data by unauthorized persons. Access to your shopping account is only possible after entering your personal password.

This website contains social media buttons. By activating the buttons, you directly contact the respective social network. They may use personal data of their users in a non-data protection compliant manner, as insufficient information is provided about the use of the data. Noser Fashion is not liable for damages caused to you by abusive use of your personal data by social networks.

APPLICABLE LAW AND JURISDICTION

The place of performance for the delivery by the seller is the respective shipping location. The place of performance for all other obligations is Vaduz/FL. The place of jurisdiction for all legal disputes arising from the business relationships is Vaduz/FL.
The contract concluded between the contracting parties remains binding even if individual provisions or individual clauses of these terms and conditions are legally ineffective. An ineffective provision and an ineffective term and condition shall be replaced in good faith by a regulation that comes closest to the purpose of the ineffective provision or condition and ensures the achievement of the economic purpose of the contract.
We do not assume any liability for possible typographical and printing errors.
